Memphis Probate Attorney
During the stressful and hectic period following the death of a loved one, it is often frustrating for families to deal with the legal issues involved in settling the decedant's affairs. At The Bradley Law Firm, PLLC, we will help you efficiently navigate the details of your Probate proceedings in the metropolitan Memphis area. Attorney J. Anthony Bradley will guide you and your family through the process.
In Tennessee, probate law requires that a lawyer handle the process of arranging for the administration of the estate of the deceased. The process can be fairly simple, if the Probate Court accepts a Will as valid, there is no contest to that Will, and the Executor or Executrix named in the Will is willing and able to take on the responsibility.
If there is no valid Will, the person who died was "intestate" and the Probate rules direct the court to appoint an Administrator to handle the estate.
In either situation, there are a number of responsibilities, including:
- Identification and notification of all potential heirs and creditors
- Publication of legally required notices
- Management of assets and real estate
- Arranging for the transfer of assets to heirs and creditors
- Filing gift, inheritance, and income taxes for the estate
